Allahabad High Court has refused to grant bail to the accused under the POCSO Act in the case of raping an 8-year-old girl. A division bench of Justice Sanjay Kumar Singh, while hearing the bail application of the accused, said that the depth of penetration does not matter in the offense of rape. The court said that girls are worshiped in our country, despite this there is a continuous increase in the cases of rape against girls.
Actually, this whole matter is of 16 July 2021, when an 8-year-old girl went to pluck guava in Gorakhpur, her neighbor Chandra Prakash Sharma molested and raped the girl. The girl told this to her mother, after which the rape was confirmed in the medical examination. After which a case was registered against the accused under Section 354, 376 of the IPC and Section 5/6 of the POCSO Act.
During the hearing on the bail plea of accused Chandra Prakash Sharma, his lawyer argued that his client has been falsely implicated in this case. There are no injury marks on the victim’s body. Along with this, the lawyer said that the victim has not said in her statement that she was raped. Hence, no offense is made out against the accused. The accused has been in jail since July 17.
After hearing the argument of the accused’s lawyer, the Allahabad High Court said that the incidents of rape have a very bad effect on the girl child. Many times, due to this, the girls go into severe depression and even thoughts of suicide. The court said that rape is not just a crime against a girl child but a crime against the society. Along with this, the court refused to grant bail to accused Chandra Prakash Sharma.
