Pakistan’s Supreme Court on Tuesday resumed hearings on the legality of dismissing the no-confidence motion and the subsequent dissolution of the National Assembly. But no final result was reached. As a result, once again the Supreme Court of Pakistan on Tuesday adjourned the hearing of the matter related to the ongoing constitutional crisis in the country till tomorrow (April 6).
Chief Justice Omar Ata Bandiyal said that he does not want to rush the hearing. At the same time, he also said that he will take the decision as soon as possible. They want to hear the matter seriously. Supreme Court has full power. Because their job is only to see the law or the constitution.
In this case, he only wants to find out the constitutionality of the steps taken by the deputy speaker to dismiss the no-confidence motion, whether the motion was justified and whether the dissolution of the National Assembly was constitutional or not. As there was a constitutional crisis in the country following the Speaker’s decision, the top court had taken a suo moto cognizance to resolve the matter on the insistence of the opposition parties, who had petitioned the court for the same.
In the previous hearing, the opposition’s lawyer Farooq H Naik had presented arguments for two hours. The top court had also rejected the request of the Pakistan People’s Party (PPP) to constitute a full bench to hear the matter. During the hearing today, Chief Justice Bandiyal said, ‘Our entire focus is on the decision of the Deputy Speaker. It is our priority to decide on that particular issue.’
Here, former minister Fawad Hussain tweeted that Prime Minister Imran Khan nominated former Chief Justice of Pakistan Justice Gulzar Ahmed for the post of caretaker prime minister after consultation and approval of the PTI core committee in response to the President’s letter to choose the caretaker prime minister.
However, the entire incident has angered the opposition. Soon after the deputy speaker’s decision, on the advice of Prime Minister Imran Khan, President Arif Alvi dissolved the National Assembly. It was informed that now elections will be held in the country within three months. But the Election Commission has said that it will be impossible to hold elections so soon. Let us tell you that the Deputy Speaker of the National Assembly rejected the no-confidence motion brought by the opposition citing Article 5 of the Constitution. He said that foreign powers do not have the right to do such acts in Pakistan in collaboration with the opposition.
