President Ram Nath Kovind has approved the law to unite the three municipal corporations of Delhi. After the approval of the President of Delhi Municipal Corporation Act (Amendment)-2022 passed by both the Houses of Parliament, Lok Sabha and Rajya Sabha, now notified by the Union Ministry of Law and Justice (Law Department). After the notification of this law, all the 272 corporation councilors of Delhi have now become former councilors. However, the term of the corporations is ending on May 18. The operation of corporations has now gone to the Special Officer, who is yet to be appointed.
After this gazette notification issued by the Secretary of the Law Ministry, Dr. Rita Vashisht on April 18, 2022, Delhi will have a mayor and a commissioner. Along with this, the number of wards will be delimited based on population. Presently the number of MCD wards are 272. At the same time, in the new law, its provision has been fixed to a maximum of 250. That is, now after delimiting the corporation wards, they will be made 250 wards based on population.
Corporation sources told that only after the process of delimitation of these wards is completed, the way for MCD elections will be cleared. At present, the elections have been postponed for up to six months. The process of integration will now be worked out by the corporation. According to the law, it may take about two years to complete this process. The provision of this period has also been mentioned in the law.
After the implementation of the new law, the interference of the Delhi government in the MCD will completely end. In the Act, referring to the section substituted for section 514A, it has been clarified that every word relating thereto shall mean the Central Government.”514A.
On and after the commencement of the Municipal Corporation of Delhi (Amendment) Act, 2022,—
(a) North Delhi Municipal Corporation, South Delhi Municipal Corporation, and East Delhi Municipal Corporation (hereinafter referred to as) erstwhile corporations), and will become part of the Municipal Corporation of Delhi.
(b) any reference to the foregoing corporations in any annexure or other instrument shall be deemed to be the reference to the Municipal Corporation of Delhi.
(c) All the properties, movable and immovable, or the corporation relating to the predecessor shall vest in the Municipal Corporation of Delhi.
(d) shall have all the rights and liabilities of the erstwhile corporations. Transferred to the Municipal Corporation, and its rights and liabilities shall be Delhi.
(e) any pending proceeding including any disciplinary, arbitration, appeal, or another legal proceeding, of whatever nature, shall be continued or enforced by or against the Municipal Corporation by or against the antecedent, Delhi Corporation will be called.
(f) any rules, regulations, and bye-laws made before such commencement, so far as they conform with the provisions of the Act, new rules, regulations, and bye-laws shall remain in force till the time they are made. For all this, a time of about two years has been fixed to implement this entire process.
If corporation sources are to be believed, due to the long time taken to complete the process, there is a strong possibility of holding the corporation elections along with the Lok Sabha elections which are to be held in 2024.
It is believed that having a corporation in Delhi will improve its financial condition. Along with this, unnecessary expenses can also be kept under control. After the implementation of this law, the interference of the Delhi government will end completely. Now all the facts or orders related to the corporation will be directly related to the central government. This will end the tussle between MCD and Delhi Government. At the same time, work will be done faster on issues related to the public interest. The officers and employees of the three Municipal Corporations of Delhi, North, East, and South Delhi Municipal Corporation will now be called employees of the Municipal Corporation of Delhi with immediate effect. But now from the date of coming into force of the new law, it will be only MCD officers and employees.
